Our Vision on the Re Rose Doctrine – Balancing Law and Humanity

The Re Rose doctrine is an equitable principle that allows property transfers or gifts to be treated as complete when a donor has done all within their power to effect the transfer, even if legal formalities remain pending.

At SC LLC, we have acted in contentious probate matters where issues of gifts, equity, and trusts have been engaged. These disputes are often deeply personal and intractable, involving not just law but family legacies and relationships.

One such case involved a beneficiary of a gift under a heavily contested will. Both sides ran into evidential gaps due to the absence of contemporaneous documents and records. By drawing on our expertise in handling sensitive family-oriented disputes, we helped our client reach a mediated settlement agreement. The resolution not only addressed the legal complexities but also honoured the personal significance of the gift to our client.

Our clients value our ability to combine fearless legal representation with empathy. As one client shared:

“Attentive and careful listeners, Shobna and her team addressed every one of my concerns and answered every question I had, which helped achieve efficient settlement of a long-running probate and estate matter. They have somehow managed to strike the perfect balance between warm congeniality and thorough professionalism, and it was a pleasure working with them.”

We have also acted in trust and probate disputes on appeal before the Court of Appeal and the Appellate Division of the High Court. In one such appellate matter, gifts and receipts of monies in a family company were contested under a patriarch’s will. We successfully argued the appeal, and the court ordered an account of the patriarch’s entire estate. Importantly, we then helped the parties reach a settlement agreement that bridged their interests. This spared both time and costs, as the Court’s order for a full accounting did not need to be carried out.

While we excel in presenting complex and novel legal arguments before the Courts, we remain deeply attuned to our clients’ best interests — including their desire to preserve family ties wherever possible.

Please do reach out to us if you/your clients face complex probate and equity and trust disputes at first instance or on appeal.

We are committed to achieving the best results in Court while keeping an eye on mediation working with our clients to ensure a swift and effective resolution of their disputes.
